This is your current contract, verbatim. My statements are underlined and highlighted. Unlike many people who wish to throw legalities out the window like trash, here is what a judge, a jury, a board of inquiry will base their interpretation on, your contract.



This Agreement entered into by and between Executive Jet Aviation, Inc. (hereinafter "Company") (whom I do not work for) and the International Brotherhood of Teamsters, Chauffeurs, Warehousemen and Helpers of America, Airline Division (hereinafter "Union") as representative of Captains and First Officers of the Company, (hereinafter "Pilots" or "Crewmembers") (whom I am not a member off) pursuant to the terms of the Railway Labor Act, as amended, (hereinafter the "Act") in the mutual interests of the Pilots and the Company to promote the safety and continuity of air transportation, to further the efficiency and economy of operations, and to provide for orderly collective bargaining relations pertaining to rates of pay, rules or working conditions, between the Company and its Pilots.





SECTION I RECOGNITION

1.1 Pursuant to the certification by the National Mediation Board in Case No. R-4346 dated April 25, 1973, this Agreement is made and entered into between Executive Jet Aviation, Inc., hereinafter referred to as "Company" (once again, I do not work for this company) and the International Brotherhood of Teamsters, hereinafter referred to as "Union", representing the employees composing the craft and class of Pilots (which I am not a member of, nor am I on any seniority list associated with this pilot group). The Company or employees will not negotiate individually on matters covered by this Agreement.



1.2 This Agreement shall supersede all previous Agreements by and between the Company and the Union or any other labor oganization or individual with respect to the Pilots described above and shall constitute the sole Agreement between the Company and the Union. Any and all agreements made by the parties shall be reduced to writing and signed by the authorized representatives.



1.3 All flying performed by the Company or by the Company's parent corporation, or by a subsidiary or affiliate, which is directly or indirectly controlled by the Company, or by the Company's parent corporation, or any successor in interest, or flying performed on behalf of the Company or the Company's parent corporation as a result of any agreement to which the Company or the Company's parent corporation is a party or becomes a party, or flying utilizing the NetJets logo, shall be performed by pilots named on the Executive Jet Pilots Seniority List, except as set forth in 1.4 below.



1.4 Exception to the Scope of this Agreement:



a) The Gulfstream aircraft operated and to be operated by Executive Jet International, Inc. (So here it is in black and white, your own contract, legal and binding on both parties clearly states that all NetJets flying must be preformed by NJA pilots on the NJA seniority list, except that little 13 word sentence in 1.4).





I am not authorized by the FAA, the company or your contract for that matter to operate any aircraft on the NetJets Aviation property, as you’re not on the NJI property. The fact that the corporation who owns both companies chooses to register all their aircraft with a QS tail number is immaterial to what you’re attempting to infer.



We work for different companies whom have different leadership teams (D.O.’s V.P.’s, Chief Pilots, etc.), different places of business (Headquarters), different FAA Air Carrier Certificates, different training programs, different policies and procedures, different dispatch centers, different maintenance programs, and the list goes on. It’s no different than Delta or Continental owning Comair ASA or Express Jet. Same product, seamless customer experience, different companies. I didn’t say it wasn’t crafty, only that it is 100% legal.



Place me on a Scab List and your leadership will find themselves back in court, that’s not a threat, it’s a promise. The actions of a few are despicable and tasteless.

You guys most have ZERO confidence that a strike is going to help you obtain your goals if you find it neccessary to threaten charter pilots with a "scab list". It seems completely INSANE to equate a pilot going to work just like he/she does everyday with being a "scab" just because YOU are on strike. What,are you guys afraid that the charter companies who pick up your trips are going to steal your owners and make your strike irrelevant?

For those who are not working for NetJets, they only have to be WILLING to stand up to your union's intimidation. I think you will be very supprised where their loyalty is. (although, I must say it sounds like there are some scardie-cats on this board).

I've talked to all of my 135 buddies out here on the East Coast, and it is the same answer across the board: "well, I guess I'll be flying struck work..."

Sorry, but I think you're on your own.

Sometimes I think Hoffa is making a statement with this pilot union.

A couple of guys were muzzled by the union here for talking too much and carrying on dialogue with other employees.
You will see few, if any, NJA pilots around here anymore. Their leader has spoken and off they go.....
 
I don't think they see it that way, Johnny. The expression--"leaving nothing to chance"--seems to me, a more accurate description of the talented, hard-working volunteers that are practically putting their personal lives on hold to fight for all of us....pilots and families. They are simply trying to do EVERYTHING they can to ensure success. You hear it ALL the time---NJ pilots have never been THIS organized!

Here's an interesting thought: wouldn't it be nice if a groundswell of support across the industry made management bring a real offer to the table that could lead to an actual contract. Is it not possible that a show of solidarity NOW could prevent a strike LATER? If they didn't think they could count on the charter companies to help them out...aren't some of them already saying "Sorry, too busy"?....would they still be willing to force the pilots to take it that far???

As I stated yesterday:

The actions of few, unfortunately weigh heavy on the multitude. Law Suits, Scab Lists, Seniority List stable threats and self righteous claims of being superior to all others have left NJA pilots with little support from their fellow corporate pilots and the aviation community as a whole.

1. FACFriend I'm a NJA pilot. You won't find the union telling me to quiet down. What you won't see is CS pilots post on this board EVER. The CP posts here baiting people but we all know who he is.

2. Level with their boss? You're kidding right? Charter boses aren't there to let you earn a paycheck without working. Either you fly the plane or you're out. PERIOD. Charter companies are doing quiet well on NJA's tailcoats plus of their own customers who fractional doesn't work out for. You either fly or you've got serious problems with your boss. Current charter pilots want to chime in?

3. ANY QS tail.
 
No guns here, Ace..:) You are simply sharing information and viewpoints, as I am. An informed debate, helps all of those involved.

Reminders that we need to keep confidential information off of a public forum during a sensitive time for our Local, is a common sense safe-guard while the contract is under negotiation. Griz's farewell post was self-explanatory. I was not surprised to see him take a break from this board. He's very busy these days, anyway. Pilots are always coming and going--that's nothing new...:)

The money isn't REALLY the issue with the Casino guys and gals now is it? You really should know better than to keep passing that off....

For netjetswife... You mam are out of your skull nuts ... NOONE in the charter world is going to think twice about flying a sell-off. PERIOD, get it??? What your union is saying with this scab-list deal will do EXACTLY the opposite of what you're hoping for. The rest of the charter/corporate aviation community will collectively say "up yours" ... NetJets has NO friends in corporate aviation and this isn't going to make any in the charter/135 arena. One of our aircraft for example is a corporate owned aircraft on a 135 certificate. We don't ever get NetJets sell-offs, but I know those who do on other accounts. After speaking to them, NONE OF THEM care about your threat and WILL fly ANY trip to which they are assigned, NetJets or otherwise.

Get a clue... NetJets has been screwing corporate flight departments for years thanks in part to your pathetic wages. So that's why I hope you get a great contract. Believe me it's not because I feel sorry for you, every one of you knew what the pay was when you signed on.

I've worked at a couple major corporations, at one of which NetJet's pilot resumes automatically hit the shredder because your company tried unsuccessfully to shut us down twice. Not threatening you at all, that would be juvenile... ASAP is doing a pretty good job of that for everyone with the scab-list deal.
