The U.S. District judge in New York recently dismissed the MDA lawsuit that was filed in 2005 over the terms and conditions of employment of the MDA pilots. Several claims were dismissed on their merits, while others were dismissed because the statute of limitations had run out before their lawyer had filed the complaint. The judge also allowed the plaintiffs to file a new supplemental complaint claiming that the seniority award submitted to Nicolau by the US Airways MEC Merger Committee was erroneous because the MDA pilots should not have been designated as furloughed, and therefore the award should be overturned and damages awarded. The judge made no factual findings in this claim; she allowed it to be filed and discovery on this issue to move forward. ALPA attorneys are confident that this case will be dismissed on summary judgment once discovery and evidence are submitted to the judge.
