If so, Part 23 doesn't apply. What are you trying to accomplish?

well, it's not waht I am doing.. but my friend in oversea is designing a
VLJ there and trying to get FAA certification. So do you know the answer
for my question?

Contact SETP, maybe they can help you out. Everyone I know is already working on some pretty good projects.

Try Flight Test Associates out of the Mojave Airport. They have flight test and engineering DER's on staff and they specilize in certification issues.

Your geographic FAA ACO will be able to provide you a list of flight test pilot DERs
