Court to decide if Delta can be sued over wine sales

The Georgia Supreme Court on Monday will consider whether Delta Air Lines Inc. can be sued for serving drinks to a passenger who was later involved in a traffic accident.
Jack Townsend claims he was injured in a traffic accident with William Serio, a Delta passenger who was leaving Atlanta's Hartsfield-Jackson International Airport after a flight from Milwaukee.
Townsend says Serio swerved across the center line of a road and struck his vehicle head-on.
Townsend's lawsuit claims Serio was served large amounts of red wine during the Delta flight and that Delta should be held liable under a Georgia law that makes bars accountable when a patron drinks too much then drives.
A Fulton County Superior Court judge threw the case out, saying that since the alcohol was not served to Serio in Georgia, the law doesn't apply. But the state appeals court reversed that decision, allowing the case to move forward.
Delta appealed that ruling to the state Supreme Court.
