FAR 135 CHECK AIRMAN Question.

Hello,

Regulatory requirements are: that an operator with an approved training program provide instructing, and checking under that part, for all the aircraft which it operates.
There is a liability concern.
If training and checking are conducted in the actual aircraft rather than a Simulator at an approved Training provider there is a higher ' Risk ' element involved.
This concern has been voiced by the Pilot Group and currently there is no interest or candidate to fill a now vacant Check Airman Position.
The FAA has advised by way of: FAA NOTICE 8900_432 that essentially we are obligated to have a Check Airman under FAR 135.323 (a)(4)
I am pretty sure we cannot force an Airman to become a Check Airman against their wishes.

What are the options here if any ?

You cannot be forced to be a ck airman, it is a voluntary position. You can be fired if you don't take the position, your company can be shut down by the FAA if you don't have enough ck airman. As far as checking in the airplane, I did it in the DA-20 for 14 years. You manage the risk and you don't do anything except the minimum to meet the requirements of 135.297. The training and checking should be done in a sim where riskier scenario can be introduced. We now follow 135.3 which allows training and checking under Part 121 with a LOFT qualification. No training or checking is done in the airplane now days. It is much more expensive, but gives a much better product and a higher failure rate.

Yip, how can you be fired for not applying for the Checkairman position? They can’t just grab a guy and say: “you’re now VP of Flight Operations!” And they can’t just grab a guy and say: “you’re now the Checkairman!” There has to be a selection process AND training.

depends upon management. They are most likly an At Will employer and can terminate for any reason. True you cannot be forced to be a ck airman, but management can also fire you because you pissed them off by not taking the position
